Условия продажи

Пункт № 1: Объект Общие условия продажи, описанные ниже, подробно описывают права и обязанности Happy Bike и его клиента в контексте продажи товаров на веб-сайте happy-bike.it. Отмена заказа не может повлечь за собой получение покупателем прибыли при возмещении убытков. Пункт № 5: Право на отзыв и возврат Товары, проданные на нашем сайте, никогда не возвращаются. Happy Bike не несет ответственности за порчу, частичную или полную потерю предметов и упаковки приобретенных предметов. Пункт № 8: Юрисдикция Любой спор, связанный с толкованием и исполнением настоящих общих условий продажи, регулируется итальянским законодательством. При отсутствии мирового соглашения спор между сторонами должен быть разрешен в компетентном суде итальянской юрисдикции в провинции Тренто (Италия).

Общие условия

1.The renter declares to collect the bicycle and all the rented material in perfect operating and maintenance condition. Any deficiencies or damage found on delivery must be reported to the Happy Bike staff. 2.The use of the bicycle presupposes the physical fitness and the technical expertise of those who intend to lead it. Therefore, the renter declare that the user is equipped with adequate capacity and appropriate competence to conduct a muscle or electric bicycle, without placing any reserve. 3.The bicycle is to be used exclusively as a means of transport. It is forbidden to transfer it in use to other subjects, participate in any competition and use for commercial activities. 4. The renter is responsible for the assigned bicycles, identified by a number or color, from the time of pick-up to re-delivery. The bicycle must be returned during the times indicated in this contract, in the same place where it was chartered. The bicycle is considered returned only if returned directly to Happy Bike. Parking the bicycles in front of Happy Bike during closing time does not count as a return. Failure to return the bicycles before the shop closing time, will be charged € 10 per bicycle every 30 minutes delay. Failure to return the bicycle without notice will be considered theft and will therefore be reported to the Judicial Authority. If the bicycle is not returned due to theft or abandonment, the cost of the bicycle will be charged according to the table of this contract. 5. The recovery of the bicycle is only possible on a paved road and will be charged € 50 + € 1 per Km per bicycle. 6. The theft, replacement or tampering of bicycle components will be reported to the Judicial Authority for having caused danger to the safety of others and the costs for restoring the components will be charged as on the table of this contract + maintenance costs. 7. The renter is responsible for damage caused to the bicycle and equipment during the rental period, assuming the burden of paying the sum necessary for the original restoration of the bicycle on the basis of the table shown in this contract. The use of City Bikes (normal and electric) on dirt paths such as the Strada Ponale is prohibited, and and will be fined €100. 8. In the event of theft or loss of the bicycle and its accessories, the user and/or the renter is obliged to report to the Competent Authority within 24 hours, assuming the responsibility to compensate Happy Bike on the basis of the table shown in this contract. 9. Happy Bike is exempt from liability for damages caused to themselves, to third parties and things during the use of the vehicle, and from unforeseeable or unavoidable events. No compensation can be requested at Happy Bike. 10. Happy Bike can check users during the use of bicycles and can ask for an anticipate return if the conditions of improper use of the vehicle is detected, an no refund will be done. Happy Bike may refuse to hire to people in a state of inebriation or under the influence of drugs (pursuant to Articles 186-187 of the Highway Code) and for other reasons at the unquestionable judgment of Happy Bike itself. 11. The user must comply with all national road regulations when using the bicycle, including laws prohibiting the use under the influence of alcohol or other narcotic substances, or the use of earphones or a mobile phone while pedaling. The user is entirely and personally responsible for the payment of any infringement of the Italian road regulations, including the costs deriving from the sequestration and subsequent recovery of the bicycle. The responsible user will also be charged for the days that the bicycle is not available. 12. The user accepts the following conditions: A. The obligation to wear a protective helmet when using the bicycle. B. MTB bicycles are rented without lights. C. It is prohibited to modify the bicycle without the authorization of Happy Bike. D. It is prohibited to transport passengers and/or animals on the bicycle, unless it is a specific seat and/or basket certified and approved by Happy Bike. E. Transporting animals in trailers and strollers owned by Happy Bike is prohibited and will be fined €100. F. Prohibition on transporting weights exceeding 10 Kg on the rear rack without authorization from Happy Bike. In case of use by minors: by signing this contract, the renter becomes the legal guardian of the minor user, accepting all the responsibilities specified in this contract and in the Civil Code and authorizes the minor user to use the bicycle in the conditions specified by this regulation, made exception for paragraph 12-D. I renter, accept and agree that this agreement is effective and binding on my heirs, close relatives, executors, directors and representatives, in the event of my incapacity or death. Risk assumption extends to and for people not listed in this contract and who take advantage of the rental service offered by Happy Bike, for which I sign and I assume all responsibilities, and that I inform about the contents of this. What is not mentioned in this regulation, the relationship between the parties (contractors) is governed by the Italian Civil Code. In case of lack of agreement between the parties (contractors), any dispute must be resolved at the competent court under Italian jurisdiction in the province of Trento.

1.Cancellations will be considered valid only after confirmation by email by Happy Bike. 2. Refunds will be returned within 21 days from the date of confirmation of the cancellation. 3. There are no reimbursements in case the requirements of paragraph 2 of the General Conditions are missing. 5. There are no refunds in case of cancellations due to illness or injury. If the communication occurs at least 24 hours before the start of the rental, a postponement of the rental date will be agreed based on the availability of the booked bikes. The agreed date can no longer be changed by the renter. 6. Happy Bike assumes no responsibility for cancellations of reservations due to weather conditions that do not meet the renter's needs. 7.In the event of adverse weather conditions that do not allow cycling, a postponement of the rental date will be agreed based on the availability of the booked bikes. Weather forecasts of any kind are not taken into consideration. 8. The following table shows the refund conditions in case of cancellation by the renter:
